Licenses & permissions required for an event in Goa

Compliance with the legalities involved in organizing an event, whether in India in general or Goa in particular may seem like a daunting task. Different cities have varied licensing requirements (depending on the type of event you’re hosting) and one needs to make sure that these are all obtained to avoid any legal disputes. Procuring these licenses and permissions isn’t one of the most straightforward tasks and requires a basic understanding of their purposes to determine which of them are appropriate for your event and which aren’t. This process however is far simpler in Goa as compared to other cities as the state is driven by the tourism and event industry.

Below is a list of the necessary permissions that need to be obtained as of the date on which this blog has been written. MUSIC LICENSES

IPRS (INDIAN PERFORMING RIGHT SOCIETY LIMITED)

The Indian Performing Right Society issues licenses to music users and collects royalties from them, for and on behalf of its members i.e. the authors, composers, and publishers of music and distributes this royalty among them after deducting its administrative costs.

IPRS is an essential license that needs to be obtained for playing recorded music and performing live music. Whether karaoke, a DJ, or a live band is performing at an event, this license is a must for all forms of music that have been produced by the record labels attached to it. Applicability: Playback of live & recorded music owned by record labels covered under the organization.


PPL (PHONOGRAPHIC PERFORMANCE LIMITED)

PPL India represents some of the world’s and India’s largest record labels, including Aditya Music, Lahari Music, Sony Music Entertainment, Speed Records, T-Series, Universal Music, Warner Music.

Under the Copyright Act 1957, every business entity or individual must receive permission from the copyright owners of the sound recording before any public performance takes place. PPL enforces the rights of its members by ensuring that businesses and individuals comply with the law and pay copyright holders for the music they consume. They are a non-profit organization and the royalties collected are given to the rightful owners of the music. For more information visit: www.pplindia.org

NOVEX

Novex is engaged in the business of issuing public performance rights for sound recordings. The exploitation of sound recordings with Novex rights includes public performance in hotels, restaurants, lawns, discotheque, resorts, malls, and other venues for communication to the public on a commercial basis of the following music labels: Yash Raj Films Private Limited, Zee Entertainment Enterprises Limited, Eros International Media Limited, Tips Industries Limited, Think Music, Red Ribbon Entertainment Private Limited, Third Culture Entertainment (Nucleya), U Tunes Entertainment (Sukhbir). ISRA (INDAN SINGERS RIGHTS ASSOCIATION)

If creativity is one side of the struggle, protecting the creative piece of work is the other. ISRA looks after the interests & royalties of singers. This license pays royalties to singers and artists who have performed the song as opposed to the aforementioned 3 that look after the interests of the record labels. Applicability: Playback of recorded music created by musicians covered under the organization.

PERMISSION FOR USE OF PUBLIC ANNOUNCEMENT SYSTEM

Events require the use of a public announcement system also known as the PA system in the event industry, for which permission needs to be obtained from the district collectorate office and local police authorities. In Goa, amplified music is permitted up to 22:00 hours. If you wish to continue playing music after the said time, you need to move the event to an indoor soundproof venue.

Applicability: Usage of an amplified sound system at a venue that isn’t part of private property.

EXCISE LICENSE

An excise license is a tax levied on the sale or supply of alcohol. The license is needed for events that are held outside the boundaries of premises where the owners of those premises have a license to serve/sell alcohol. If the event takes place on premises that have an excise license and is serving their alcohol, an additional license will not be applicable.

Applicability: Service and sale of alcohol on a premise that does not have an existing excise license attached to it.

BEACH PERMISSION

Goa has an abundance of serene beaches and a lot of clients prefer hosting a beach gala during their event. However, to organize any event on the beach, you need to get ‘beach permission’ from the tourism department of the state. It’s a strenuous process that begins with sending an application to the Coastal Regulation Authority to get a CRZ clearance. Post that an application must be made to the Tourism department with the CRZ certificate attached to it. This process does take a long time hence it`s always advisable to apply for it at least 45 days in advance. Depending on the association the hotel shares with the local civic body, an acknowledgment may or may not be required from the village panchayat or the municipality depending on whose jurisdiction the beach comes under.

Applicability: Events being held on the beach in Goa.

VENUE PERMISSION

Seeking venue permission applies only if you are using public spaces like a stadium, open ground, auditoriums, parks, streets, etc. For example, if the venue has been allocated to a state department then permissions are granted for the same by the governing body of the said department. Before applying for this, one should have a plan and means of sorting out parking for the event and garbage disposal post it.

For events planned and executed on public spaces like the beach or open grounds, one must obtain a no-objection certificate from the city police, traffic police, fire brigade, and emergency services.
